For those watching trends in electronic discovery, the debate about proposed amendments to the Federal Rules of Civil Procedure to address concerns over the rising costs of preservation and risk of spoliation sanctions have been under discussion for more than two years. On June 3, 2013, the Judicial Conference of the United States’ Standing Committee on Rules of Practice and Procedure voted to approve the proposed amendments to the FRCP for public comment, a key step on their path toward adoption.
