A Supreme Court ruling last year has made it impossible for plaintiffs who experience bad reactions to generic drugs to obtain legal remedies.
Pharmaceutical giant Pfizer Inc. was accused by Walgreen Co. and several other prescription drug retailers of violating U.S. antitrust law. The retailers claim Pfizer’s Wyeth unit and Teva Pharmaceutical Industries Ltd illegally kept a generic version of popular antidepressant Effexor XR off the market.
Chalk one up for the drug companies. In a hotly contested decision, the Supreme Court yesterday ruled in Pliva, Inc. v. Mensing that generic drug companies are immune from consumer lawsuits alleging misleading product labeling.
