Alternative Fee Arrangements (AFAs): Value-Based Billing for the In-House Law Department

Increasingly, in-house law departments are investigating alternative fee arrangements (AFAs) as a means by which to align the value delivered by an outside law firm with the amount charged for services. The details of these arrangements may vary significantly by case, by firm and by client. This discussion will address considerations to address when creating AFAs, and how a law department’s e-billing system can support and enforce these arrangements.

Craig Raeburn - CT TyMetrix

Craig Raeburn is Vice President, Product Management at CT TyMetrix, where he is responsible for overseeing the company’s product strategy and execution of product development. He has extensive knowledge and experience delivering high-end technology-based solutions to law departments and insurance carriers. Since joining CT TyMetrix in 2002, he has helped grow the company to the leading provider of hosted e-billing, matter management and business intelligence technologies for law departments and claims organizations. His prior experience includes serving as the Vice President, ASP services for Daticon, a litigation software and services company, and has held numerous positions within corporate law departments, legal service providers and has also worked as an independent consultant serving the legal industry.

Keith Brown - Baker, Robbins and Company

Keith Brown is a consultant in the Law Department Service Line of Baker, Robbins and Company, a consulting firm devoted to the legal industry, where he focuses on e-billing, matter management, collaborative tools, business intelligence and system integrations. Prior to joining Baker, Robbins, Keith was Director, Product Management for CT TyMetrix, where he led the development of CT TyMetrix 360°, an integrated e-billing, matter management and document management and reporting platform. In this role. Keith also led the first implementation of the LEDES XML 2.0 billing format, designed for globalized e-billing and tax handling. He holds a JD from Northeastern University School of Law and practiced law for ten years with a medium sized litigation boutique in Boston, Massachusetts.

Jennifer Pearce - International Paper

Jennifer Pearse has over twenty years experience in the legal industry in various roles.  Jennifer joined International Paper in 1991.  Prior to International Paper, Jennifer worked for a law firms and the Circuit Court Clerk’s office.  During her time at International Paper, she has held several positions within the Legal Department including Senior Litigation Paralegal, Legal Resource Coordinator, and IT Project Leader.  Her current position is Manager of Legal Operations & Records Management.  In this position, she is responsible for managing the operations of the department including financial planning, reporting, analysis and controls.  In addition, she manages the Records Management group for the company who is responsible for policies, procedures, processes, and compliance in managing the company’s records.  She also acts as a project manager for e-discovery efforts within the company.
