Proposed Canadian anti-spam bill goes beyond its U.S. equivalent.

You've Got Spam 

According to Charles Morgan of McCarthy Tetrault, the following would be included as spam in the absence of express consent under Canada’s proposed Electronic Commerce Protection Act:

  • E-mails to an existing customer or supplier that propose more business under the contract, include an updated price or product list or suggest a meeting, if the sender entered a long-term contract more than 18 months before the communication;
  • E-alerts or newsletters from professional firms to clients for whom they have not provided services in the past 18 months, if the material contains a link to the firm’s Web site or promotes the firm in any way;
  • E-newsletters with advertisements, even to persons who have been receiving them without objection for years, unless the sender has done business with the recipient in the past 18 months;
  • Newsletters, business publications or company information to anyone who has made a relevant inquiry if it was made more than six months earlier.
