Messaging Mess

IM, Facebook and Twitter open new areas of discoverable ESI.

Smoking Guns

Several recent scandals have involved instant messaging and text messaging. In 2008, Detroit’s mayor, Kwame Kilpatrick, resigned after he sent lewd text messages to an assistant with whom he was having an affair. He lied about it and served four months in prison.

Florida congressman Mark Foley resigned his office in 2006 after sending explicit instant messages to a former congressional page.

And the founders of social networking Web site ConnectU alleged in 2008 that Facebook founder Mark Zuckerberg stole coding to create his massively popular site. ConnectU tried to get out of a settlement between the parties, claiming it had found "smoking gun" instant messages that would make their case. But the judge did not let ConnectU out of the settlement.
