Too Many Infringements

In their view, The music companies have been going easy on Joel Tenenbaum. Although he is facing more than $1 million in potential liability, his situation could be a lot worse.

"Our evidence suggests Tenenbaum had hundreds of [infringing] tracks in his share folder," says RIAA Senior VP Jennifer Pariser. "We don’t seek damages on that many works because that would run up damages to an excessive amount."

That sounds similar to an argument that Tenenbaum defense lawyer Chalres Nesson makes against statutory damages. He states in his brief, "Aggregation ... of punitive statutory damage awards exacerbates their ... excessiveness."

In any event, the music companies may not be done aggregating damages here. They are contemplating suing Tenenbaum for more than seven songs. "It is likely to be more than seven," Pariser says.
