The Parent Trap: EEOC Provides Employers with Caregiver Guidance 

EEOC best practices provide employers with a road map to avoid caregiver pitfalls.

How does an employer avoid litigation over caregiver responsibilities? Joseph Lynett of Jackson Lewis suggests some preventive medicine:

  • Train HR managers in the requirements of Title VII and analogous state law. Some states already mandate caregiver protection.
  • Investigate and address employee complaints. You should already have a procedure in place for an employee to air a grievance.
  • Review policies and practices concerning decisions such as hiring, promotions, terminations and granting leave to make sure the criteria driving those decisions are nondiscriminatory and applied on a uniform basis.
  • Make the decision-making process as transparent as possible so there is little opportunity for an employee or an agency investigating a claim to inappropriately speculate as to what actually was driving your decision.
