Consumer Concern: Canadian Product Safety Measures May Finally Take Effect 

The product safety measures Canada introduced in 2007 may finally take effect.

Safe and Rule-Bound 

The proposed Canada Consumer Product Safety Act will replace Part I of the current Hazardous Products Act. Under the proposed bill, the government will introduce new safety obligations that suppliers will be required to meet, and new tools for Health Canada to compel corrective action. The act will:

  • Prohibit the manufacture, importation, advertisement or sale of consumer products that pose an unreasonable danger to human health or safety.
  • Provide mandatory recall powers to remove unsafe consumer products from store shelves as soon as a problem is discovered.
  • Increase fines for suppliers who do not to take appropriate corrective action to address unsafe products.
  • Require suppliers, upon written direction by the Minister of Health, to provide the results of test and safety reports and to notify Health Canada of any serious injuries or illnesses resulting from the use of their products.
  • Establish an offense related to falsely packaging or labeling products and making deceptive claims as they relate to health or safety.
  • Require suppliers to maintain product records for traceability, among other purposes.
