Conte's Impact 

If the California appeals court decision stands, Conte v. Wyeth could have broad implications outside the pharmaceutical arena.

"If there’s a sufficient similarity between whatever product the consumer ultimately uses and whatever product the entity in question is making a statement about, the court could say it’s foreseeable that statements about Product X could impact on the consumer’s decision to buy or use Product Y," says Mark Haddad, chair of the Los Angeles appellate practice group at Sidley Austin. In his view, the opinion is not limited to the pharmaceutical industry but more broadly addresses "tort law, what it means to make a negligent misrepresentation, and how it can be foreseeable for that statement to affect the choices that others make."

Given the weighty and novel issues the case presents, Haddad says it’s likely Conte will end up before California’s highest court.

"The California Supreme Court will look very hard at whether to give this case further review, because it does raise the kind of fundamental fairness questions that you would often look to your state supreme court to render the final opinion on," he says.
