Counsel turn to early case assessment solutions to help determine litigation strategy.

Technology doesn’t always have to come into play with early case assessment (ECA). Oftentimes outside counsel will perform an ECA on behalf of their clients to evaluate, plan and implement cost-effective litigation resolution strategies.

"It is a collaborative effort with in-house counsel to build at the earliest juncture a strategic litigation plan with a corresponding budget," says Thomas E. Birsic, a partner at K&L Gates.

K&L Gates puts its ECA down in writing within 60 to 90 days of the case filing, and the format, content and scope of the assessment is tailored to the specific lawsuit. The firm examines the key facts of the case, the allegations, who the opposing counsel is, who the judge presiding over the case is and a number of other details to help determine overall case strategy.
