Samsung Electronics Co. isn’t giving up its fight against Apple Inc.
The South Korean company says it plans to amend its existing U.S. patent lawsuits against California-based Apple to include the new iPhone 5 as another product that infringes on its technology. The iPhone 5 hits stores tomorrow, and Apple already has secured orders for more than 2 million phones.
“Samsung anticipates that it will file, in the near future, a motion to amend its infringement contentions to add the iPhone 5 as an accused product,” Samsung said in a court filing. “Based on information currently available, Samsung expects that the iPhone 5 will infringe the asserted Samsung patents-in-suit in the same way as the other accused iPhone models.”
Samsung also is spreading its animosity toward Apple on the airwaves. In a new ad campaign, Samsung pokes fun at diehard Apple fans and touts the features of its own Galaxy S III smartphone.
The new ads and legal announcement come just less than a month after a jury ordered Samsung to pay Apple $1.05 billion in damages for copying features of the iPhone and iPad.
