Keynote

The saga of Mark Whitacre—an Archer Daniels Midland (ADM) executive, turned FBI informant, turned embezzler—was so dramatic that is became the 2009 movie “The Informant,” starring Matt Damon.

InsideCounsel’s SuperConference will kick off with “The Real Story Behind ‘The Informant,’”a keynote panel featuring several of the key players in the ADM price fixing investigation. Panelists include Judge James Epstein, former FBI Financial Crimes supervisor Anthony D’Angelo, Kirkland & Ellis partner James Mutchnik, Sidley Austin partner Scott Lassar and Robert Herndon, an FBI special agent assigned to Whitacre’s case.

Ethics

Following the keynote address, Brian Martin, senior vice president and general counsel of KLA-Tencor Corp., will host the first of a two-part “Ethics Boot Camp” series, which will focus on the latest ethical dilemmas facing in-house counsel.

Day one will feature an overview of the Model Rules, techniques for managing client relationships and a primer on reporting requirements. In the second session, conference attendees can submit their own ethical questions for discussion.

Law department management

During tough economic times, productivity and cost management are essential to running a successful legal department. Learn more about management techniques and effective team structuring at “Managing Up: How to Structure Your Team to Empower Your Own Productivity.”

Lauryn Haake, vice president of the consulting division at Duff & Phelps Legal Management, will moderate the discussion. Fellow presenters include Colleen Batcheler, executive VP and GC of ConAgra Foods; Gail Sharps Myers, senior VP and deputy GC of U.S. Foods Inc.; and Karen Wishart, executive VP and chief legal officer at TV-One.

Litigation management

Technology-assisted document review received a measure of official support with Judge Andrew Peck’s ruling in Da Silva Moore v. Publicis Groupe. But practical questions about its effectiveness and defensibility remain. Doug Stewart, director of technology at Daegis will share his insights on using technology to reduce e-discovery costs, while still ensuring compliance.

Joining Stewart in the discussion are Jason Fliegel, director of e-discovery and records management at Abbott Laboratories; Jeff Sharer, partner at Sidley Austin; Adam Farber, managing director of document review services at Daegis; and Judge David Waxse.

Managing a legal department requires effective communication with both internal executives and external entities. “Legal Challenges at the General Counsel and CEO Level,” offers first-hand accounts from senior in-house counsel, who will share their experiences navigating legal issues with company leaders and outside law firms.

The panelists for this event are Gene Landoe, a member of Datacert Inc.’s board of directors; Edward Ryan, executive VP and GC of Marriott International; Janice Block, executive VP, GC and chief compliance officer at Kaplan Higher Education; and Nadia Dombrowski, senior VP and lead region counsel for U.S. markets at MasterCard Worldwide.

Substantive issues

In 2010, the Dodd-Frank Act introduced regulatory changes with far-reaching implications for many businesses. Bruce Collins, corporate VP and GC of C-SPAN will help SuperConference attendees sort through the key issues in the 900-page document. Panel members will discuss of the Act’s provisions, its effect on businesses and the focus of government regulators.

The panel also will feature Mary Ann Hynes, GC and chief compliance officer of Corn Products International Inc. and John Gordon Seymour, GC of the Public Company Accounting Oversight Board.
