A judge in New York has ruled that luxury designer Gucci may move forward with its trademark infringement suit against Guess Inc.
Gucci, based in Italy, first filed suit against Guess three years ago, claiming the American clothing company was trying to “Gucci-ize” some of its products. Specifically, Gucci said in its suit that Guess infringed on six of its designs. U.S. District Judge Shira Scheindlin in Manhattan said yesterday that Gucci may pursue claims regarding four of those trademark infringement claims: its green-red-green stripes, a script logo, a stylized "Square G" and a group of four interlocking "G"s known as a "Quattro G."
Judge Scheindlin agreed with Gucci’s claim that Guess may have acted in bad faith and that the designs could reasonably cause confusion among consumers. She said, however, that Gucci lacked evidence to pursue its two other claims.
